One of the most common ways that a person may pursue family-based immigration to the United States is through sponsorship by a family member. In many cases, the fastest and easiest way to obtain authorization to enter the U.S. is through an Immediate Relative (IR) visa. Certain types of close family members of U.S. citizens can are eligible for these visas, and an IR visa will provide a person with authorization to enter the United States and receive a green card. Immigrant Visas for Immediate Relatives of U.S. Citizens

If a person is the immediate relative of a U.S. citizen, they will usually be eligible to receive a visa that will allow them to come to the United States and live in the country permanently. The following people are considered immediate relatives:

  • Spouses of U.S. citizens, including same-sex spouses who have been legally married and common-law spouses who have been recognized as legally married in their home country
  • Minor, unmarried children (under the age of 21) of U.S. citizens
  • Parents of U.S. citizens, as long as the citizen is 21 years old or more

There is no waiting period for IR visas, and there are no limits on the number of these types of visas that can be issued each year. If there are any bars to adjustment that would affect a person's ability to become a permanent resident, such as working in the United States without authorization or failing to maintain lawful immigration status, a person who qualifies for an Immediate Relative visa may be able to receive an exception that will allow them to apply for a green card.

A U.S. citizen who maintains a principal residence in the United States can sponsor an immediate relative for a visa by filing a Petition for Alien Relative (Form I-130). The sponsor will also need to submit an affidavit of support stating that are responsible for providing for the needs of their immigrant relative(s). After receiving a visa, a person may travel to a U.S. port-of-entry and ask for permission to enter the U.S. If immigration officials determine that the person is applicable to be admitted to the U.S., they will receive lawful permanent resident status and be eligible for a green card. Immediate relatives who are currently in the United States and who qualify for an IR visa may qualify for an adjustment of status, which will allow them to become lawful permanent residents and receive a green card.
